1. Acceptance of Terms
By accessing or using the website, services, or software (including TMS Plus, Educare360, Fee Mitra, and Hospital Management Systems) provided by Growvaa Digital Solutions (“Company”, “we”, “us”), you agree to be bound by these Terms & Conditions.
If you do not agree to abide by these terms, please do not use our services. We reserve the right to modify these terms at any time, and your continued use of the services constitutes acceptance of the modified terms.
2. Description of Services
Growvaa provides a range of digital and management solutions:
Digital Services
Website development, social media marketing, and HR services are provided on a project or retainer basis. Delivery timelines (e.g., 24 hours for the ₹999 starter kit) begin once all required assets are received.
Education ERP (SaaS)
Our software (TMS Plus, Educare360) is provided as a service. Access is dependent on internet connectivity and subscription status. We strive for 99.9% uptime but do not guarantee uninterrupted access.
Healthcare & Staffing
Hospital management software and doctor staffing services are governed by specific service agreements separate from these general terms.
3. User Accounts & Security
To access our ERP systems or client portals, you may be required to create an account. You are responsible for:
- Maintaining the confidentiality of your password.
- Restricting access to your computer/account.
- All activities that occur under your account or password.
Growvaa cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
4. Payment & Subscription Terms
Service Fees
Certain services (like the ₹999 website package) require full payment upfront. For subscriptions (ERP), fees are billed annually or monthly as selected.
Refund Policy
Once digital services (website design/marketing) have commenced, fees are non-refundable. For ERP subscriptions, refunds are processed on a pro-rata basis only if the service fails materially.
5. Intellectual Property
The content, layout, design, and source code of the Growvaa platform and software are owned by Growvaa Digital Solutions and are protected by copyright laws.
- Client Data: You retain ownership of the data you input into our systems (Student records, Patient data, etc.).
- Custom Work: Upon full payment, you are granted a license to use the specific website or creative assets designed for you. You do not own the underlying platform code.
- Trademarks: “Growvaa”, “TMS Plus”, “Educare360”, and “Fee Mitra” are registered trademarks of Growvaa.
6. Prohibited Uses
You may not use our services to:
- Upload viruses or malicious code.
- Attempt to gain unauthorized access to our servers or other users’ data.
- Use the Education ERP for purposes other than managing educational institute data (e.g., reselling the software access illegally).
- Violate any local, state, national, or international law.
7. Limitation of Liability
To the fullest extent permitted by law, Growvaa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service.
8. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation.
